Section 8.2.3.1 of Texas General Statutes (TCS) provides as follows: (a) An entity that owns more than 50% of the equity interest of the nonparticipating royalty owner shall obtain a consent of an owner to permit the nonparticipating royalty owner to lease, under such terms as specified in the agreement, any and all the rights granted to an owner. If the owner grants consent to the lessee, the lessee shall own, regardless of the percentage of ownership, rights specified in the agreement and may participate in any joint venture that results from the lease. A lessee may not charge for any services provided after the execution, and the terms of the agreement, of the agreement to lease. Notwithstanding any provision of the Agreement or any collective bargaining agreement to the contrary, the lessee shall not be subject to any requirement to pay a premium to the owner.
