This office lease clause states that in the event the tenant becomes a debtor under Chapter 7 of the federal Bankruptcy Code and the Trustee of the tenant's property or the tenant elects to assume the lease for the purpose of assigning the same or otherwise, such election and assignment may only be made if all of the terms and conditions are satisfied. If such Trustee shall fail to elect or assume the lease within sixty (60) days after the filing of the petition, the lease shall be deemed to have been rejected.

Fulton Georgia Landlord Bankruptcy Clause is a legal provision that outlines the rights and responsibilities of landlords and tenants in the event of the landlord filing for bankruptcy in Fulton County, Georgia. This clause is included in lease agreements to safeguard the interests of both parties and ensure that appropriate actions are taken in such circumstances. It provides clarity on several crucial aspects related to the lease, including the treatment of security deposits, lease termination, and ongoing rental payments. Under this clause, there are different types of provisions that can be included in the lease agreement to determine the course of action in the event of a landlord's bankruptcy: 1. Lease Termination Rights: This provision determines the rights of both parties regarding the lease agreement if the landlord declares bankruptcy. It may allow the tenant to terminate the lease early without penalties or fees or require the tenant to continue payments to a court-appointed trustee or new landlord. 3. Notice Requirements: The clause may specify the notice period the landlord must provide to the tenant before filing bankruptcy, ensuring tenants have sufficient time to seek alternative housing arrangements and protect their rights. 4. Appointment of a Trustee: In some cases, the lease may appoint a trustee to oversee the property and ensure rents are collected and allocated appropriately during bankruptcy proceedings. This provision clarifies the responsibilities of the trustee and the rights of tenants in dealing with them. 5. Payment Allocation: If the landlord files for bankruptcy after receiving rental payments, this clause may address how those payments will be allocated. It may require that the payments be applied towards future rent or be refunded to the tenant if the lease is terminated.
