In order to fight the CPO, the respondent has to show up to the full hearing. Some courts will sometimes schedule a short hearing called a response hearing to determine if the full hearing even needs to take place, whereas other courts will schedule the full hearing directly after issuing the CPO.

If either the victim or the abuser wants to drop the CPO altogether, the person must file a form called Motion to Modify or Terminate Domestic Violence Protection Order, or CPO. If the victim files this form, she must assure the court she is not being bullied, threatened or harassed into doing so.

After a full hearing, the order may be issued for up to 5 years.

A CPO can last up to five years but if the respondent (abuser) is under age 18 when the order is issued against him/her, the order can only last until s/he turns 19 (unless it is renewed/extended).

The judge can order protection for up to five years. The order can also protect your children or other family and household members if they are in danger. Having a protection order does not guarantee your safety. Sometimes, asking for a protection order can make the violence worse.

At the time an ex parte CPO is issued, the Court sets the case for a full hearing with both sides present. The full hearing is usually 10 to 14 days after the ex parte hearing.
